Terms and Conditions (T&C)

1. Scope

The operator provides its members with access to the facilities and equipment during opening hours (24 hours a day, 365 days a year – except as per section 10). Usage is limited to the term of the membership contract. The BO and the NR, which form an integral part of the contract, must be observed at all times.

2. Conditions

WAREHOUSE GYM FITNESS GmbH is the operator of WAREHOUSE GYM in Visp-Eyholz. These Terms and Conditions (hereinafter “T&C”) apply to the use of the facilities and equipment of WAREHOUSE GYM. The T&C, the Operating Regulations (BO) and the User Regulations (NR) form an integral part of the contract and are binding for every member.

3. Current Contractual Conditions

By using the facilities and equipment, the member accepts the T&C, the BO and the NR. The operator reserves the right to amend these regulations if necessary. The current versions of the T&C, BO and NR are available at all times at www.warehousegym.ch. It is the member’s responsibility to stay informed about the currently applicable conditions

4. Membership

4.1 Membership is personal and non-transferable. Persons aged 16 and above are permitted to train at WAREHOUSE GYM. Minors must additionally submit a parental/guardian consent form signed by their legal representative. Memberships do not renew automatically.
4.2 The member acknowledges that a photograph may be taken for visual access control to the facilities and equipment of WAREHOUSE GYM. This photograph is used exclusively for access control and will not be used for any other purpose. It is deleted one year after termination of the membership contract.
4.3 An active membership cannot be cancelled. Exceptions include relocation (section 11.3), a medical training exemption (section 11.4), or a house ban (section 12). All cancellations must be submitted in writing.
4.4 For quality reasons, the operator reserves the right to limit the number of members.

5. Services and Prices

5.1 The operator offers different membership options. The available services depend on the chosen membership type. Details can be found on the current price list, available at www.warehousegym.ch. The operator may adjust prices at any time. It is the member’s responsibility to stay informed about current prices.
5.2 All prices are in Swiss francs (CHF), including VAT, unless otherwise stated.

6. Membership Card

6.1 The member receives an electronic card or QR code as a membership and access pass.

7. Health Condition

If the member has not exercised regularly during the past two years, has an impaired general health condition, has experienced a serious illness, or has undergone a medical procedure (operation, etc.) within the past two years, a medical check-up is recommended before starting training.

8. Payment

8.1 The membership fee is due and payable upon conclusion or renewal of the contract.
8.2 Accepted payment methods at reception are cash, Twint and credit cards.
8.3 Accepted credit cards are MasterCard, VISA, and EC Card.

9. Liability

9.1 WAREHOUSE GYM is not continuously staffed or supervised. Use of the facilities and equipment is at the member’s own risk.
9.2 Any liability of the operator or its staff for damages resulting from accidents, injuries, or illnesses is expressly excluded.
9.3 Members are liable for any damage caused to the facilities, equipment, or devices through improper use. Parents are liable for their children.
9.4 The operator is not liable for the loss of personal belongings. Liability for items deposited at reception or for theft within the facilities is also excluded. It is the member’s responsibility to arrange appropriate insurance coverage.

10. Opening Hours

The facilities and equipment of WAREHOUSE GYM are open 24 hours a day, except during maintenance, cleaning, renovation, or reconstruction work. The operator may adjust services and operating hours at any time. Members are not entitled to refunds or membership extensions resulting from such operational closures or schedule changes.

11. Non-Use, Time Stop, and Refunds

11.1 Non-use of the facilities does not entitle the member to a reduction or refund of membership fees.
11.2 Under certain conditions, the operator offers the possibility of a “Time Stop,” meaning a temporary suspension of the membership. During a suspension, the membership is extended by the approved duration.
A Time Stop is granted in the following cases:
– Medically certified inability to train due to illness or accident.
– Documented travel of more than 28 days (e.g., flight tickets, passport stamps, travel itinerary).
– Documented study stay abroad of more than 28 days.
– Documented work assignment abroad of more than 28 days.
– Pregnancy and maternity (up to 14 weeks). For longer periods, a medical certificate is required. The birth must be documented.
– Military or civil service of more than 21 days (proof via conscription order).
No other reasons entitle the member to a Time Stop. The Time Stop must be requested in advance at reception along with supporting documents. Retroactive approval is only possible in the event of accident/illness or pregnancy/maternity. Time credit is added seamlessly to the membership. Refunds are excluded. In case of misuse, the operator reserves the right to terminate the contract immediately without refund.
11.3 In the event of relocation, refunds of paid membership fees are possible if the new residence is more than 50 km from WAREHOUSE GYM. Fees are refunded pro rata temporis minus an administrative fee of CHF 100. A relocation certificate must be enclosed with the written cancellation.
11.4 In the event of a medically prescribed training exemption, refunds of paid membership fees are possible pro rata temporis. Refunds are reduced by an administrative fee of CHF 100. A medical certificate must be enclosed with the written cancellation.

12. Violations / House Ban

Serious or repeated violations of the T&C, BO, NR or staff instructions may result in a house ban and/or immediate termination of the membership without refund. Misuse of the membership card or access card may result in legal action.

13. Amendments to the T&C, BO, and NR

The member acknowledges that amendments to the T&C, BO and NR may occur at any time. It is the member’s responsibility to stay informed about the currently applicable versions. No rights may be derived from changes to these documents.

14. Data Protection

We respect the right to privacy. The operator stores data, membership documents, and information required for the administration and execution of memberships to the necessary extent. No data will be passed on to third parties. After expiry of the statutory retention period, all member data is deleted unless the membership is active.

Swiss law applies. The place of jurisdiction is Visp.
